5 year old Jay Jones has won the right to compensation following a personal injury claim after being attacked by another child.
The incident happened when both boys were 3 years old and were left alone in the back of a car. The young perpetrator repeatedly hit Jay Jones with a car jack resulting in Jay needing hospital treatment.
The offender who cannot be named for legal reasons has not been prosecuted because of his age. He has since been taken into care.
The Criminal Injuries Compensation Authority (CICA) twice refused the claim as it was disputed whether a 3 year old could be responsible for a crime of violence.
Jay’s mum Renai Williams said “This has been a long and hard-fought process. We have been knocked back twice by the CICA because, in my opinion, they didn’t take my son’s case seriously. My son was hit 11 times on his head and face with a car jack, his attacker kept on lashing out even though Jay was screaming out in pain and covered in blood.”
Jay will now be undergoing a series of psychological tests to determine what level of compensation will be awarded to him.
