In some cases car accidents are not caused by driver error, but by dangerous road conditions. This could include pot holes, surface water caused by blocked drains or ice and snow. The Highways Authority has a duty to maintain the roads and to ”ensure, so far as is reasonably practicable, that safe passage along a highway is not endangered by snow or ice”.
