A man who suffered serious injuries as a result of a car accident has been told that he can now claim compensation for his injuries. Ben Wilkinson suffered the injuries whilst he was a passenger in a car belonging to his mother, but which was being driven at the time by his friend, Kieran Fitzgerald.
The insurance company, Churchill, initially stated that Mr Wilkinson would not be entitled to any personal injury compensation on the basis that he had allowed Mr Fitzgerald to drive the car, and Mr Fitzgerald did not have insurance. However, under a recent court ruling Churchill must now cover Mr Fitzgerald in respect of Mr Wilkinson’s accident claim.
The judge on the case, Mr Justice Blair, stated: “I consider the insurer’s contention in the present case results in the claimant victim being entirely uncompensated for his injuries, which is not a permissible outcome under the directives.”
